Real Life Somerville Police Stories:William BEERS (OUI, Receive Stolen MV)

On Wednesday April 12, 2017, I, Officer Bork was assigned to mark unit 784 patrolling area East 4. At approximately 02:23 myself and East 1, Officer Lorenti were dispatched to Broadway and Bond Street for a check conditioned of a male passed out behind the wheel of a motor vehicle. East 3 Officer Khoury, and West 5, Officer Fusco responded as well.

 

Upon arrival, we saw MA Reg. XXXXX in the middle of Bond Street at the corner of Broadway, both public ways in the city of Somerville. As we approached the motor vehicle, I observed male, later identified as William Beers, sitting in the driver’s seat with the keys in the ignition, car running, and slumped forward. The window to the vehicle was down and we were able to make entry. Mr. Beers was unresponsive to our presence, and after several attempts, Mr. Beers opened his eyes and began to attempt to speak in a slurred manner. There was a strong odor of alcoholic beverage emanating from him, he was speaking with slurred words, and his eyes were dilated and glassy. Mr. Beers became immediately tumultuous in his behavior and refused to answer any questions. He spontaneously stated that he had been drinking. When asked to exit the vehicle Mr. Beers refused and attempted to drive away. Mr. Beers was guided out of the motor vehicle onto the ground and placed into handcuffs. Mr. Beers tumultuous behavior continued, and he stated that “I’m a functioning alcoholic of course I was drinking and driving.”

 

Based on the above information and my observations, I believed Mr. Beers to be operating under the influence of alcohol. Mr. Beers was searched and transported in unit 200 by Officer Berrouet to Somerville Police Headquarters where he was booked in the usual manner by Lt. DeOliveira.

 

The vehicle that Mr. Beers was operating was towed and MA uniform citation (R#7882743) was issued for:

 

C90 S24 OUI Liquor, 5th Offense and C90 S23 Operating MV with License Suspended for OUI.

 

During the booking process, Mr. Beers was offered the chance to a Breath Test, to which he declined.

 

Also during the booking process, it was ascertained that the vehicle that Mr. Beers had been operating MA Reg. XXXXX, was just reported stolen to Boston Police. Mr. Beers is additionally charged with C266 S28 Receiving a Stolen Motor Vehicle. A copy of the stolen vehicle report from Boston Police will be submitted into evidence.
